FIRE SUPPRESSION SYSTEM PURCHASE AGREEMENT, DISCLAIMER, AND LIABILITY WAIVER
IMPORTANT: PLEASE READ CAREFULLY BEFORE COMPLETING YOUR PURCHASE.
DO NOT STAY ON YOUR PROPERTY WHILE A FIRE IS APPROACHING.
THE SYSTEM IS NOT A SUBSTITUTE FOR PROPERTY OR FIRE INSURANCE UNDER ANY CIRCUMSTANCES. CUSTOMER
ACKNOWLEDGES THAT THEY ARE SOLELY RESPONSIBLE FOR OBTAINING AND MAINTAINING ADEQUATE INSURANCE COVERAGE
FOR THEIR PROPERTY.
By purchasing, installing, or using the fire suppression system (“System”), you (“Customer”) agree to the
following terms:
1. NO GUARANTEE OF PERFORMANCE
The System is designed to help reduce the risk of fire damage. HOWEVER:
- The System does NOT guarantee prevention of fire, property damage, injury, or death.
- Wildfires and structural fires are unpredictable and may exceed the System’s capabilities.
- Performance depends on factors outside of our control, including but not limited to:
- Water availability and pressure
- Power availability
- Weather conditions (wind, heat, embers)
- Proper installation and maintenance
Customer acknowledges the System is not a substitute for professional firefighting services.
2. ASSUMPTION OF RISK
Customer understands and agrees that:
- Fire protection involves inherent risks.
- Use of the System may not prevent loss.
- Customer assumes all risks related to installation, use, and outcomes.
3. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- EMCO FIRE SYSTEMS shall NOT be liable for:
- Property damage
- Loss of home or structures
- Personal injury or death
- Loss of data or connectivity (app/geolocation features)
- This applies whether claims arise from:
- Product use or misuse
- Failure to activate
- Partial or complete system failure
- Failure to properly maintain the system
4. NO LIABILITY FOR MISUSE OR IMPROPER INSTALLATION
We are not responsible for damages resulting from:
- Improper installation
- Unauthorized modifications
- Failure to follow instructions
- Use outside intended conditions
5. CUSTOMER RESPONSIBILITIES
Customer agrees to:
- Properly install the System (or hire qualified professionals)
- Maintain and test the System regularly
- Ensure adequate water and power supply
- Monitor system status
Failure to meet these responsibilities voids any implied protections.
6. THIRD-PARTY DEPENDENCIES
The System may rely on third-party services (e.g., mobile apps, internet connectivity, GPS). We are not
responsible for:
- Service outages
- Connectivity failures
- Data inaccuracies
7. WARRANTY DISCLAIMER
THE SYSTEM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
We disclaim all warranties, including: Merchantability, Fitness for a particular purpose, Continuous or
error-free operation.
8. INDEMNIFICATION
Customer agrees to defend, indemnify, and hold harmless EMCO FIRE SYSTEMS from any claims, damages, or
losses arising from: Use or misuse of the System, Failure to follow guidelines, Third-party claims related
to the System.
9. LIMITATION OF DAMAGES
- If liability is found despite this agreement: Total liability shall be limited to the amount paid for
the System.
10. ACKNOWLEDGMENT & ACCEPTANCE
By completing purchase, Customer acknowledges: They have read and understood this agreement, They accept
all terms voluntarily, They understand the System is risk mitigation only, not guaranteed protection.
